Terms and Conditions

The terms that govern your use of BarberHub.

Effective date: [EFFECTIVE_DATE]

BarberHub is currently operating as a pilot (beta) service. This document applies during the pilot phase and may be updated as the service develops.

These Terms and Conditions ("Terms") govern your access to and use of the BarberHub platform at barberhub.my, operated by [OPERATOR NAME], a sole proprietorship registered in Malaysia (SSM Registration No. [SSM REGISTRATION NO.]) ("BarberHub", "we", "us", "our").

By accessing or using BarberHub, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Definitions

  • "Platform" means the BarberHub website, applications, and services.
  • "Shop" means a barber shop that registers to manage bookings on the Platform.
  • "Barber" means a staff member linked to a Shop.
  • "Customer" means a person who books an appointment through the Platform.
  • "User" means any person who accesses the Platform.

2. About BarberHub

BarberHub is a booking and management platform that connects Customers with Shops and Barbers. We are a technology provider only. We do not own, operate, or control any Shop and we do not provide grooming or barber services ourselves.

Any appointment is a contract between the Customer and the Shop. BarberHub is not a party to that contract and is not responsible for the quality, safety, timing, or outcome of services provided by a Shop or Barber.

3. Eligibility and accounts

You must be at least 18 years old, or have the consent of a parent or guardian, to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for safeguarding your password and for all activity under your account. Notify us immediately of any unauthorised use.

4. Roles and responsibilities

Shop owners are responsible for the accuracy of their shop information, services, pricing, operating hours, and the conduct of their Barbers, and for complying with applicable laws including the PDPA in respect of their own customers.

Barbers are responsible for maintaining accurate availability and honouring confirmed appointments.

Customers are responsible for providing accurate booking details and attending or cancelling appointments in good time.

5. Bookings, cancellations, and no-shows

When you book, you submit a request that is subject to the Shop's availability and acceptance. Booking, cancellation, and no-show policies are set by each Shop and may be enforced by the Shop directly.

BarberHub is not responsible for appointments that are cancelled, rescheduled, or not honoured by a Shop or Customer.

6. Fees and payments

Online payment is not currently processed through the Platform. Payment for services is made directly to the Shop unless stated otherwise.

If online payments are introduced, additional terms and a third-party payment processor will apply, and those terms will be presented before you transact.

7. Acceptable use

You agree not to:

  • Use the Platform for any unlawful, fraudulent, or harmful purpose.
  • Make false, speculative, or abusive bookings.
  • Upload content that is unlawful, infringing, offensive, or that you have no right to share.
  • Attempt to gain unauthorised access to the Platform, other accounts, or related systems.
  • Interfere with, disrupt, or place undue load on the Platform or its infrastructure.

8. User content and intellectual property

You retain ownership of content you submit, such as shop photos and descriptions. You grant BarberHub a non-exclusive, royalty-free licence to host, display, and use that content for the purpose of operating and promoting the Platform.

All rights in the Platform itself, including software, design, and trademarks, belong to BarberHub or its licensors. You may not copy, modify, or reverse-engineer any part of the Platform without our written consent.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, or secure, nor do we warrant the conduct or services of any Shop or Barber.

10. Limitation of liability

To the fullest extent permitted by law, BarberHub shall not be liable for any indirect, incidental, special, or consequential loss, or for loss of profits, data, or goodwill, arising from your use of the Platform or from any service provided by a Shop or Barber.

Nothing in these Terms excludes liability that cannot be excluded under Malaysian law, including the Consumer Protection Act 1999 where it applies.

11. Indemnity

You agree to indemnify and hold harmless BarberHub from any claims, losses, or expenses arising out of your breach of these Terms or your misuse of the Platform.

12. Suspension and termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms or if we reasonably consider it necessary to protect the Platform or other users. You may close your account at any time.

13. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We may amend these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute arising from these Terms or your use of the Platform.
